LE DIRECTOIRE DE LA BANQUE CENTRALE EUROPÉENNE,

vu le traité sur le fonctionnement de l’Union européenne, et notamment son article 127, paragraphe 2,

vu les statuts du Système européen de banques centrales et de la Banque centrale européenne, et notamment leur article 11.6 et leurs articles 17, 22 et 23,

vu l’orientation BCE/2007/2 du 26 avril 2007 relative au système de transferts express automatisés transeuropéens à règlement brut en temps réel (TARGET2),

vu la décision BCE/2007/7 du 24 juillet 2007 relative aux modalités de TARGET2-BCE,

considérant ce qui suit:

(1) Le 15 septembre 2010, le conseil des gouverneurs de la Banque centrale européenne (BCE) a adopté l’orientation BCE/2010/12 modifiant l’orientation BCE/2007/2 relative au système de transferts express automatisés transeuropéens à règlement brut en temps réel (TARGET2) afin, entre autres: a) de tenir compte des mises à jour liées à la mise en service de la version 4.0 de TARGET2, notamment pour permettre aux participants d’accéder à un ou plusieurs comptes MP en utilisant l’accès par l’internet; et b) de répercuter un certain nombre de changements techniques à la suite de l’entrée en vigueur du traité sur le fonctionnement de l’Union européenne et de clarifier quelques questions.

(2) Il s’impose d’apporter à la décision BCE/2007/7 les modifications rendues nécessaires afin de mettre en œuvre certains éléments de l’orientation BCE/2010/12 dans les modalités de TARGET2-BCE,

Article premier Modification des modalités de TARGET2-BCE

L’annexe de la décision BCE/2007/7 contenant les modalités de TARGET2-BCE est modifiée conformément à l’annexe de la présente décision.

Article 2 Entrée en vigueur

La présente décision entre en vigueur le jour suivant sa publication au Journal officiel de l’Union européenne.

ANNEXE

Les modalités de TARGET2-BCE sont modifiées comme suit:

1. L’article 1er est modifié comme suit:

les définitions suivantes sont remplacées:

addressable BIC holder means an entity which: (a) holds a Business Identifier Code (BIC); (b) is not recognised as an indirect participant; and (c) is a correspondent or customer of a direct participant or a branch of a direct or indirect participant, and is able to submit payment orders to and receive payments from a TARGET2 component system via the direct participant,

credit institution means either: (a) a credit institution within the meaning of §1(1) of the KWG that is subject to supervision by a competent authority; or (b) another credit institution within the meaning of Article 123(2) of the Treaty on the Functioning of the European Union that is subject to scrutiny of a standard comparable to supervision by a competent authority,

public sector body means an entity within the public sector, the latter term as defined in Article 3 of Council Regulation (EC) No 3603/93 of 13 December 1993 specifying definitions for the application of the prohibitions referred to in Articles 104 and 104b(1) of the Treaty,

b)

sont remplacés par ce qui suit:

les termes Bank Identifier Code (BIC) means a code as defined by ISO Standard No 9362,

Business Identifier Code (BIC) means a code as defined by ISO Standard No 9362,;

c)

dans la définition de technical malfunction of TARGET2, le point final est remplacé par une virgule;

la définition suivante est ajoutée:

User Detailed Functional Specifications (UDFS) means the most up-to-date version of the UDFS, which is the technical documentation that details how a participant interacts with TARGET2.

2. L’article 28, paragraphe 2, est modifié comme suit:

3. À l’article 32, paragraphe 2, le terme Community est remplacé par le terme Union.

4. L’article 33, paragraphe 1, est remplacé par le texte suivant:

Participants shall be deemed to be aware of, and shall comply with, all obligations on them relating to legislation on data protection, prevention of money laundering, the financing of terrorism, proliferation-sensitive nuclear activities and the development of nuclear weapons delivery systems, in particular in terms of implementing appropriate measures concerning any payments debited or credited on their PM accounts. Participants shall also acquaint themselves with the network service provider’s data retrieval policy prior to entering into the contractual relationship with the network service provider.

5. À l’article 34, paragraphe 1, le terme SWIFT est remplacé par le terme BIC.
