EUROPOS CENTRINIO BANKO VYKDOMOJI VALDYBA,

atsižvelgdama į Sutartį dėl Europos Sąjungos veikimo, ypač į jos 127 straipsnio 2 dalį,

atsižvelgdama į Europos centrinių bankų sistemos ir Europos centrinio banko statutą, ypač į jo 11 straipsnio 6 dalį ir 17, 22 bei 23 straipsnius,

atsižvelgdama į 2007 m. balandžio 26 d. Gaires ECB/2007/2 dėl Transeuropinės automatizuotos realaus laiko atskirųjų atsiskaitymų skubių pervedimų sistemos (TARGET2),

atsižvelgdama į 2007 m. liepos 24 d. Sprendimą ECB/2007/7 dėl TARGET2-ECB sąlygų,

kadangi:

(1) 2010 m. rugsėjo 15 d. Europos centrinio banko (ECB) valdančioji taryba priėmė Gaires ECB/2010/12, kuriomis iš dalies keičiamos Gairės ECB/2007/2 dėl Transeuropinės automatizuotos realaus laiko atskirųjų atsiskaitymų skubių pervedimų sistemos (TARGET2), inter alia, a) siekiant atsižvelgti į TARGET2 4.0 versijos atnaujinimus, ypač tam, kad naudodamiesi internetine prieiga dalyviai galėtų naudotis viena arba daugiau MM sąskaitų; ir b) siekiant atspindėti kai kuriuos techninius pakeitimus, atsiradusius įsigaliojus Sutarčiai dėl Europos Sąjungos veikimo, ir paaiškinti kai kuriuos dalykus.

(2) Siekiant įgyvendinti kai kurias Gairių ECB/2010/12 nuostatas TARGET2-ECB sąlygose, būtina padaryti atitinkamus Sprendimo ECB/2007/7 dalinius pakeitimus,

PRIĖMĖ ŠĮ SPRENDIMĄ:

Sprendimo ECB/2007/7 priedas, kuriame įtvirtintos TARGET2-ECB sąlygos, iš dalies keičiamas pagal šio sprendimo priedą.

2 straipsnis Įsigaliojimas

Šis sprendimas įsigalioja kitą dieną po jo paskelbimo Europos Sąjungos oficialiajame leidinyje.

TARGET2-ECB sąlygos iš dalies keičiamos taip:

credit institution means either: (a) a credit institution within the meaning of §1 (1) of the KWG that is subject to supervision by a competent authority; or (b) another credit institution within the meaning of Article 123(2) of the Treaty on the Functioning of the European Union that is subject to scrutiny of a standard comparable to supervision by a competent authority,

public sector body means an entity within the public sector, the latter term as defined in Article 3 of Council Regulation (EC) No 3603/93 of 13 December 1993 specifying definitions for the application of the prohibitions referred to in Articles 104 and 104b(1) of the Treaty

Participants shall be deemed to be aware of, and shall comply with, all obligations on them relating to legislation on data protection, prevention of money laundering, the financing of terrorism, proliferation-sensitive nuclear activities and the development of nuclear weapons delivery systems, in particular in terms of implementing appropriate measures concerning any payments debited or credited on their PM accounts. Participants shall also acquaint themselves with the network service provider’s data retrieval policy prior to entering into the contractual relationship with the network service provider.
