EL CONSEJO DE LA UNIÓN EUROPEA,
Vistox el Tratado de Funcionamiento de la Unión Europea,
Visto el Reglamento (CE) n.o 1346/2000 del Consejo, de 29 de mayo de 2000, sobre procedimientos de insolvencia, y en particular su artículo 45,
Vista la propuesta de la Comisión Europea,
Considerando lo siguiente:
(1) Los anexos A, B y C del Reglamento (CE) n.o 1346/2000 contienen las designaciones atribuidas en la legislación nacional de los Estados miembros a los procedimientos y síndicos a los que se aplica dicho Reglamento. El anexo A enumera los procedimientos de insolvencia a los que se refiere el artículo 2, letra a). El anexo B establece los procedimientos de liquidación a los que se refiere el artículo 2, letra c). En el anexo C figuran los síndicos a los que se refiere el artículo 2, letra b), del Reglamento.
(2) El 28 de octubre de 2014 y el 4 de diciembre de 2015, Eslovaquia y Polonia, respectivamente, notificaron a la Comisión, a efectos del artículo 45 del Reglamento (CE) n.o 1346/2000, las modificaciones introducidas en las listas establecidas en los anexos A, B y C de dicho Reglamento. Dichas modificaciones cumplen los requisitos establecidos en el mencionadoReglamento. Dado que estas modificaciones ya están en vigor, el presente Reglamento debe entrar en vigor tan pronto como sea posible.
(3) El Reino Unido e Irlanda están vinculados por el Reglamento (CE) n.o 1346/2000, y, en virtud del artículo 45 de dicho Reglamento, participan, por tanto, en la adopción y la aplicación del presente Reglamento.
(4) De conformidad con los artículos 1 y 2 del Protocolo n.o 22 sobre la posición de Dinamarca, anexo al Tratado de la Unión Europea y al Tratado de Funcionamiento de la Unión Europea, Dinamarca no participa en la adopción del presente Reglamento y no está vinculada por el mismo ni sujeta a su aplicación.
(5) Procede, por tanto, modificar en consecuencia los anexos A, B y C del Reglamento (CE) n.o 1346/2000.
HA ADOPTADO EL PRESENTE REGLAMENTO:
Artículo 1
Los anexos A, B y C del Reglamento (CE) n.o 1346/2000 se sustituyen por el texto establecido en el anexo del presente Reglamento.
Artículo 2
El presente Reglamento entrará en vigor al día siguiente de su publicación en el Diario Oficial de la Unión Europea. El presente Reglamento será obligatorio en todos sus elementos y directamente aplicable en los Estados miembros de conformidad con los Tratados.
