EIROPAS KOMISIJA,

ņemot vērā Līgumu par Eiropas Savienības darbību,

ņemot vērā Eiropas Parlamenta un Padomes Direktīvu 2014/90/ES (2014. gada 23. jūlijs) par kuģu aprīkojumu un ar ko atceļ Padomes Direktīvu 96/98/EK, un jo īpaši tās 35. panta 2. punktu,

tā kā:

(1) Komisija ir pilnvarota ar īstenošanas aktiem norādīt projektēšanas, būvniecības un veiktspējas prasības un testēšanas standartus kuģu aprīkojumam, kas ietilpst Direktīvas 2014/90/ES piemērošanas jomā, kā arī datumus, no kuriem šie testēšanas standarti ir jāpiemēro. Šīs prasības un standarti ir noteikti Direktīvā 2014/90/ES norādītajos starptautiskajos instrumentos.

(2) Lai ņemtu vērā jaunākās izmaiņas, piemērojamo starptautisko instrumentu saraksts būtu regulāri jāatjaunina. Lai nodrošinātu visaptverošu sarakstu, kurā ir visi ražojumi, uz ko attiecas Direktīva 2014/90/ES, Komisijas Īstenošanas regula (ES) 2019/1397 būtu jāatceļ.

(3) Kuģu aprīkojums, uz ko nesen attiecinātas Savienības harmonizētās prasības atbilstīgi Direktīvai 2014/90/ES, šīs regulas pielikuma 1. slejā būtu skaidri jānorāda kā jaunas aprīkojuma vienības.

(4) Ir pamatoti un samērīgi pietiekami ilgā pārejas periodā ļaut arī turpmāk laist tirgū un uzstādīt uz ES kuģa jaunu aprīkojuma vienību, kas atbilst pirms šīs regulas spēkā stāšanās dalībvalstī spēkā esošajām tipa apstiprināšanas valsts prasībām.

(5) Lai veicinātu saskaņotu, ātru un vienkāršu Direktīvas 2014/90/ES īstenošanu, saskaņā ar minēto direktīvu pieņemtajiem īstenošanas aktiem vajadzētu būt īstenošanas regulām.

(6) Šajā regulā paredzētie pasākumi ir saskaņā ar Kuģošanas drošības un kuģu izraisītā piesārņojuma novēršanas komitejas atzinumu,

IR PIEŅĒMUSI ŠO REGULU.

1. pants Projektēšanas, būvniecības un veiktspējas prasības un testēšanas standartus, kas paredzēti Direktīvā 2014/90/ES norādītajos starptautiskajos instrumentos, piemēro katrai pielikumā norādītajai kuģu aprīkojuma vienībai.

2. pants Īstenošanas regulu (ES) 2019/1397 atceļ.

3. pants

1. Kuģu aprīkojumu, kas pielikuma 1. slejā norādīts kā jauna aprīkojuma vienība, iekļauta ar Īstenošanas regulu (ES) 2018/773 un kas atbilst pirms 2018. gada 19. jūnija dalībvalstī spēkā esošajām tipa apstiprināšanas valsts prasībām, drīkst turpināt laist tirgū un uzstādīt uz ES kuģa līdz 2021. gada 19. jūnijam.

2. Kuģu aprīkojumu, kas pielikuma 1. slejā norādīts kā jauna aprīkojuma vienība, iekļauta ar Īstenošanas regulu (ES) 2019/1397 un kas atbilst pirms 2019. gada 3. oktobra dalībvalstī spēkā esošajām tipa apstiprināšanas valsts prasībām, drīkst turpināt laist tirgū un uzstādīt uz ES kuģa līdz 2022. gada 3. oktobrim.

3. Kuģu aprīkojumu, kas pielikuma 1. slejā norādīts kā jauna aprīkojuma vienība, iekļauta ar Īstenošanas regulu (ES) 2020/1170 un kas atbilst pirms 2020. gada 1. septembra dalībvalstī spēkā esošajām tipa apstiprināšanas valsts prasībām, drīkst turpināt laist tirgū un uzstādīt uz ES kuģa līdz 2023. gada 1. septembrim.

4. pants Šī regula stājas spēkā divdesmitajā dienā pēc tās publicēšanas Eiropas Savienības Oficiālajā Vēstnesī.

Piezīmes, kas attiecināmas uz visu pielikumu a)

Vispārīga piezīme. Papildus šajā pielikumā īpaši norādītajiem testēšanas standartiem tipa pārbaudē (tipa apstiprināšanā) prasīta atbilstība starptautisko konvenciju un attiecīgo IMO rezolūciju un cirkulāru piemērojamajām prasībām. Šāda atbilstība ir norādīta atbilstības novērtēšanas moduļos Direktīvā 2014/90/ES.

3. sleja. Ja divi testēšanas standartu komplekti ir atdalīti ar vai, saskaņā ar IMO veiktspējas standartiem katrs no komplektiem atbilst visām testēšanas prasībām; tādējādi pietiek veikt testēšanu, izmantojot vienu testēšanas standartu komplektu, lai apliecinātu atbilstību attiecīgo starptautisko instrumentu prasībām. Turpretī, ja izmantoti citi atdalīšanas līdzekļi (piemēram, komats), piemēro visas uzskaitītās atsauces.

6. sleja. Ņemot vērā kuģubūves termiņus atkarībā no konkrētā kuģu aprīkojuma raksturlielumiem, jēdzienu uzstādīšana uz kuģa interpretē šādi (norādīts iekavās aiz datumiem): I aprīkojuma pirmreizēja uzstādīšana tam paredzētajā vietā uz ES kuģa; II aprīkojuma pirmreizēja uzstādīšana tam paredzētajā vietā vai uzglabāšana tam paredzētajā vietā uz ES kuģa; III aprīkojuma piegāde uz kuģu būvētavu, ja tas notiek 30 mēnešu laikā pirms aprīkojuma pirmreizējās uzstādīšanas tam paredzētajā vietā.

Ja vienai kuģu aprīkojuma vienībai norādītas divas rindas (piemēram, MED/3.12), otrajā (apakšējā) rindā ir ietvertas atjauninātas starptautisko instrumentu prasības attiecībā pret pirmajā (augšējā) rindā minētajām prasībām.

Iepriekšējā punktā, proti, d) punktā, norādītajos gadījumos, ja 5. un 6. slejā nav norādīts datums, tas nozīmē, ka testēšanas standartos nav veiktas izmaiņas un attiecīgā kuģu aprīkojuma vienība atbilst apakšējā (otrajā) rindā norādītajām prasībām.

Ja vienai kuģu aprīkojuma vienībai norādītas vairāk nekā divas rindas (piemēram, MED/3.51a), apakšējā rindā ir ietvertas atjauninātās starptautisko instrumentu prasības attiecībā pret augšējās rindās norādītajām prasībām.

1. Dzīvības glābšanas līdzekļi 2. sleja. Piemēro IMO MSC Cirkulāru 980, ja vien tas nav aizstāts ar 2. slejā norādītajiem konkrētajiem instrumentiem.
