EUROPA-KOMMISSIONEN HAR —
under henvisning til traktaten om Den Europæiske Unions funktionsmåde,
under henvisning til Europa-Parlamentets og Rådets forordning (EU) 2016/429 af 9. marts 2016 om overførbare dyresygdomme og om ændring og ophævelse af visse retsakter på området for dyresundhed (dyresundhedsloven), særlig artikel 259, stk. 1, og
ud fra følgende betragtninger:
(1) Infektion med fåre- og gedepestvirus er en infektiøs sygdom, der rammer får og geder og kan have alvorlige konsekvenser for den pågældende dyrepopulation og landbrugets rentabilitet og forårsage forstyrrelser i flytninger af sendinger af disse dyr og produkter heraf inden for Unionen og eksporten til tredjelande.
(2) I tilfælde af et udbrud af infektion med fåre- og gedepestvirus hos får eller geder er der alvorlig risiko for spredning af sygdommen til andre virksomheder med får eller geder.
(3) Kommissionens delegerede forordning (EU) 2020/687 supplerer reglerne om bekæmpelse af de listeopførte sygdomme, der er omhandlet i artikel 9, stk. 1, litra a), b) og c), i forordning (EU) 2016/429, og som er defineret som kategori A-, B- og C-sygdomme i Kommissionens gennemførelsesforordning (EU) 2018/1882. Navnlig er der ved artikel 21 og 22 i delegeret forordning (EU) 2020/687 fastsat bestemmelser om oprettelse af en restriktionszone i tilfælde af udbrud af en kategori A-sygdom, herunder infektion med fåre- og gedepestvirus, og om anvendelse af visse foranstaltninger i denne zone. Desuden fastsættes det i artikel 21, stk. 1, i nævnte delegerede forordning, at restriktionszonen skal omfatte en beskyttelseszone, en overvågningszone og om nødvendigt supplerende restriktionszoner rundt om eller op til beskyttelses- og overvågningszonerne.
(4) Kommissionens gennemførelsesafgørelse (EU) 2024/2132 blev vedtaget på grundlag af forordning (EU) 2016/429, og deri fastsættes visse hasteforanstaltninger vedrørende infektion med fåre- og gedepestvirus i Grækenland. I henhold til gennemførelsesafgørelse (EU) 2024/2132 skal de beskyttelses- og overvågningszoner og supplerende restriktionszoner, der skal oprettes af denne medlemsstat efter udbrud af sygdommen i henhold til delegeret forordning (EU) 2020/687, som minimum omfatte de områder, der er opført i bilaget til nævnte gennemførelsesafgørelse.
(5) Efter datoen for vedtagelsen af gennemførelsesafgørelse (EU) 2024/2132 har Grækenland underrettet Kommissionen om yderligere otte udbrud af infektion med fåre- og gedepestvirus på virksomheder, hvor der holdes får og geder. Seks af disse udbrud fandt sted i den regionale enhed Larisa i regionen Thessalien, et i den regionale enhed Vestattika i regionen Attika og et i den regionale enhed Korinth i regionen Peloponnes. Som følge heraf blev de områder, der er opført som beskyttelses- og overvågningszoner samt supplerende restriktionszoner for Grækenland i bilaget til gennemførelsesafgørelse (EU) 2024/2132, ændret ved Kommissionens gennemførelsesafgørelse (EU) 2024/2156.
(6) Siden datoen for vedtagelsen af gennemførelsesafgørelse (EU) 2024/2156 har Grækenland underrettet Kommissionen om yderligere 24 udbrud af infektion med fåre- og gedepestvirus på virksomheder, hvor der holdes får og geder, otte i den regionale enhed Korinth, fire i den regionale enhed Larisa, tre i den regionale enhed Aetolia-Acarnania, to i den regionale enhed Rodopi, to i den regionale enhed Ilia, to i den regionale enhed Iraklio, et i den regionale enhed Trikala, et i den regionale enhed Drama og et i den regionale enhed Karditsa. Ti af disse udbrud, nemlig udbruddene i de regionale enheder Aetolia-Acarnania, Rodopi, Ilia, Iraklio og Drama, ligger uden for de allerede oprettede restriktionszoner.
(7) Siden begyndelsen af den nuværende epidemi har Grækenland i alt underrettet Kommissionen om 47 udbrud af infektion med fåre- og gedepestvirus, som udgør mindst to særskilte ophobninger: den ene i den regionale enhed Trikala og den anden i den regionale enhed Larisa.
(8) De områder, der er opført som beskyttelses- og overvågningszoner og supplerende restriktionszoner for Grækenland i bilaget til gennemførelsesafgørelse (EU) 2024/2132, bør derfor ændres med hensyn til sted og tidsrum for at forhindre yderligere spredning af sygdommen i Grækenland og resten af Unionen, og datoerne for regionalisering bør tilpasses. Det er derfor nødvendigt at ændre listen over restriktionszoner i bilaget til nævnte gennemførelsesafgørelse.
(9) Størrelsen af beskyttelses- og overvågningszonerne og de supplerende restriktionszoner og varigheden af de foranstaltninger, der skal anvendes i dem, bør baseres på kriterierne i artikel 64, stk. 1, i forordning (EU) 2016/429 og reglerne i delegeret forordning (EU) 2020/687, herunder den epidemiologiske situation med hensyn til infektion med fåre- og gedepestvirus i de områder, der er berørt af sygdommen, og den generelle epidemiologiske situation med hensyn til infektion med fåre- og gedepestvirus i den berørte medlemsstat samt risikoniveauet for yderligere spredning af sygdommen. Foranstaltningernes varighed bør også tage hensyn til de internationale standarder i Verdensorganisationen for Dyresundheds (WOAH) sundhedskodeks for terrestriske dyr. I den nuværende epidemiologiske situation er der en høj risiko for yderligere spredning af sygdommen, navnlig fordi dette er første gang, der rapporteres om udbrud i de regionale enheder Aetolia-Acarnania, Rodopi, Ilia, Iraklio og Drama, som alle ligger uden for de allerede oprettede restriktionszoner, og også første gang, der rapporteres om et udbrud i den regionale enhed Karditsa.
(10) På grund af den epidemiologiske situations alvor og hastende karakter og for straks at begrænse spredningen af sygdommen er det nødvendigt at sikre, at der ikke foretages flytninger af dyr fra beskyttelses- og overvågningszonerne og den supplerende restriktionszone til bestemmelsessteder uden for den supplerende restriktionszone, og at udelukke eventuelle undtagelser fra forbuddet mod flytning af dyr som fastsat i delegeret forordning (EU) 2020/687 i en vis periode for at forhindre spredning af sygdommen over lange afstande.
(11) Da den epidemiologiske situation i Unionen med hensyn til spredningen af infektion med fåre- og gedepestvirus tilsiger en hurtig indsats, og da der er behov for at forhindre sygdommen i at blive spredt fra de angrebne virksomheder i Grækenland til andre dele af nævnte medlemsstat eller andre medlemsstater, bør de ændringer, der skal foretages til gennemførelsesafgørelse (EU) 2024/2132 ved nærværende afgørelse, finde anvendelse hurtigst muligt.
