  1. Preamble

By Regulation (EC) No 2022/95, the Council imposed a definitive anti-dumping duty on imports of ammonium nitrate falling within CN codes 31023090 and 31024090 and originating in Russia. By Decision 2008/577/EC the European Commission accepted the undertaking offers with a quantitative ceiling from, among others, the Russian producers Open Joint Stock Company (JSC in Russian OAO) Acron and JSC Dorogobuzh, members of Acron Holding Group. The existing anti-dumping measures were extended for another 5 years, after an expiry review pursuant to Article 11(2) of Council Regulation (EC) No 1225/2009, by Commission Implementing Regulation (EU) No 999/2014. The undertaking continues to be in force after the extension of the measures. JSC Dorogobuzh is a company located in Russia, member of the Acron Holding Company, whose exports to the European Union of ammonium nitrate are subject to an undertaking by the aforementioned Decision. The company has informed the Commission that on 24 August 2015 it changed its name into Public Joint Stock Company (PJSC in English and ПАО in Russian) Dorogobuzh. It has argued that the name change does not affect its rights to benefit from the undertaking applied to it under its previous name of JSC Dorogobuzh. The Commission has examined the information supplied and concluded that the name change in no way affects the findings of Implementing Regulation (EU) No 999/2014 and Decision 2008/577/EC. Therefore, the reference to JSC Acron, Veliky Novgorod, Russia and JSC Dorogobuzh, Dorogobuzh, Russia, members of Acron Holding Company should be read as JSC Acron, Veliky Novgorod, Russia and PJSC Dorogobuzh, Dorogobuzh, Russia, members of Acron Holding Company in Article 1 of Decision 2008/577/EC. The TARIC additional code A532 previously attributed to JSC Acron and JSC Dorogobuzh, shall apply to JSC Acron and PJSC Dorogobuzh respectively.
