EUROPA-KOMMISSIONEN HAR —

under henvisning til traktaten om Den Europæiske Unions funktionsmåde,

under henvisning til Europa-Parlamentets og Rådets forordning (EU) 2016/429 af 9. marts 2016 om overførbare dyresygdomme og om ændring og ophævelse af visse retsakter på området for dyresundhed (dyresundhedsloven), særlig artikel 230, stk. 1, og artikel 232, stk. 1 og 3, og

ud fra følgende betragtninger:

(1) I henhold til forordning (EU) 2016/429 skal sendinger af dyr, avlsmateriale og animalske produkter komme fra et tredjeland eller territorium eller en zone eller et kompartment deri, der er listeopført i overensstemmelse med artikel 230, stk. 1, i nævnte forordning, for at kunne indføres til Unionen.

(2) Ved Kommissionens delegerede forordning (EU) 2020/692 fastsættes de dyresundhedsmæssige krav, som sendinger af visse arter og kategorier af dyr, avlsmateriale og animalske produkter fra tredjelande eller territorier eller fra zoner eller — for så vidt angår akvakulturdyr — kompartmenter deri skal opfylde for at kunne indføres til Unionen.

(3) Ved Kommissionens gennemførelsesforordning (EU) 2021/404 er der fastlagt lister over tredjelande eller territorier eller zoner deri, hvorfra det er tilladt at indføre de arter og kategorier af dyr, avlsmateriale og animalske produkter, der er omfattet af delegeret forordning (EU) 2020/692, til Unionen. Listerne og visse generelle regler vedrørende disse er indeholdt i bilag I-XXII til nævnte forordning.

(4) Bilag V og XIV til gennemførelsesforordning (EU) 2021/404 indeholder navnlig listerne over tredjelande eller territorier eller zoner deri, hvorfra det er tilladt at indføre sendinger af henholdsvis fjerkræ og avlsmateriale af fjerkræ og fersk kød af fjerkræ og fjervildt til Unionen.

(5) USA har underrettet Kommissionen om 35 udbrud af højpatogen aviær influenza (HPAI) hos fjerkræ i delstaterne Arkansas (2), California (8), Colorado (1), Kansas (2), Michigan (1), Minnesota (7), North Dakota (1), Ohio (3), South Dakota (5) og Wisconsin (5), som blev bekræftet mellem den 22. november 2023 og den 13. december 2023 ved laboratorieanalyse (RT-PCR).

(6) Efter disse nylige udbrud af HPAI oprettede veterinærmyndighederne i USA restriktionszoner på mindst 10 km omkring de angrebne virksomheder og gennemførte sanering med henblik at bekæmpe forekomsten af HPAI og begrænse spredningen af sygdommen.

(7) USA har indsendt oplysninger til Kommissionen om den epidemiologiske situation i landet og de foranstaltninger, der er truffet for at forhindre yderligere spredning af HPAI.

(8) Disse oplysninger er blevet evalueret af Kommissionen. Kommissionen finder, at i betragtning af dyresundhedssituationen i de områder, der er omfattet af restriktioner, og som er oprettet af USA's veterinærmyndigheder, bør indførsel til Unionen af sendinger af fjerkræ og avlsmateriale af fjerkræ og fersk kød af fjerkræ og fjervildt fra disse områder suspenderes for at beskytte Unionens dyresundhedsstatus.

(9) Desuden har Det Forenede Kongerige og USA forelagt Kommissionen ajourførte oplysninger om den epidemiologiske situation på deres område for så vidt angår HPAI, der gav anledning til suspensionen af indførsel af visse produkter til Unionen, jf. bilag V og XIV til gennemførelsesforordning (EU) 2021/404.

(10) Det Forenede Kongerige har forelagt ajourførte oplysninger om den epidemiologiske situation i landet i forbindelse med et udbrud af HPAI hos hobbyfjerkræ i Aberdeenshire i Skotland, som blev bekræftet den 23. oktober 2023.

(11) USA har forelagt ajourførte oplysninger om den epidemiologiske situation i forbindelse med tre udbrud af HPAI på fjerkrævirksomheder i staterne Montana og South Dakota, som blev bekræftet den 10. oktober 2023 og den 17. oktober 2023.

(12) Det Forenede Kongerige og USA har også forelagt oplysninger om de foranstaltninger, de har truffet for at forhindre yderligere spredning af HPAI. Efter udbruddene af HPAI har de navnlig gennemført sanering for at bekæmpe og begrænse spredningen af sygdommen, og de har også gennemført den nødvendige rengøring og desinfektion efter gennemførelsen af saneringen på den inficerede fjerkrævirksomhed på deres område.

(13) Kommissionen har evalueret de oplysninger, som Det Forenede Kongerige. og USA har forelagt, og finder, at de har givet passende garantier for, at den dyresundhedsmæssige situation, der gav anledning til suspensionen af indførsel fra de berørte zoner i de pågældende tredjelande af visse produkter til Unionen, jf. bilag V og XIV til gennemførelsesforordning (EU) 2021/404, ikke længere udgør en trussel mod dyre- eller folkesundheden i Unionen, og at indførsel til Unionen af de pågældende sendinger fra de berørte zoner i Det Forenede Kongerige og USA, hvorfra indførsel til Unionen er blevet suspenderet, derfor igen bør tillades.

(14) Bilag V og XIV til gennemførelsesforordning (EU) 2021/404 bør derfor ændres for at tage hensyn til den nuværende epidemiologiske situation med hensyn til HPAI i USA og Det Forenede Kongerige.

(15) Endvidere indeholder artikel 2 i Kommissionens gennemførelsesforordning (EU) 2023/2688 visse berigtigelser af bilag V og XIV til gennemførelsesforordning (EU) 2021/404 for så vidt angår lukkedatoen (slutdatoen) for en zone i Det Forenede Kongerige. Der er konstateret en fejl med hensyn til henvisningen til den del af bilag XIV, hvor en af disse berigtigelser skulle have været foretaget. Denne fejl bør derfor berigtiges i bilag XIV til gennemførelsesforordning (EU) 2021/404. Der pågældende bilag bør derfor ændres.

(16) Under hensyntagen til den nuværende epidemiologiske situation i USA med hensyn til HPAI og for at undgå unødige forstyrrelser af handelen med Det Forenede Kongerige og USA, bør ændringerne af bilag V og XIV til gennemførelsesforordning (EU) 2021/404, der foretages ved nærværende forordning, træde i kraft hurtigst muligt.

(17) Berigtigelsen af fejlen i bilag XIV til gennemførelsesforordning (EU) 2021/404, der blev indført ved gennemførelsesforordning (EU) 2023/2688, bør finde anvendelse fra den 16. november 2023, da det var anvendelsesdatoen for del II i bilaget til gennemførelsesforordning (EU) 2023/2688.

(18) Foranstaltningerne i denne forordning er i overensstemmelse med udtalelse fra Den Stående Komité for Planter, Dyr, Fødevarer og Foder —

Artikel 1 Ændring af gennemførelsesforordning (EU) 2021/404

Bilag V og XIV til gennemførelsesforordning (EU) 2021/404 ændres som angivet i del I i bilaget til nærværende forordning.

Artikel 2 Berigtigelse af gennemførelsesforordning (EU) 2021/404

Bilag XIV til gennemførelsesforordning (EU) 2021/404 berigtiges som angivet i del II i bilaget til nærværende forordning.

Artikel 3 Ikrafttræden og anvendelse

Denne forordning træder i kraft dagen efter offentliggørelsen i Den Europæiske Unions Tidende. Artikel 2 finder dog anvendelse fra den 16. november 2023.
