EUROPA-KOMMISSIONEN HAR —
under henvisning til traktaten om Den Europæiske Unions funktionsmåde,
under henvisning til Europa-Parlamentets og Rådets forordning (EU) 2016/429 af 9. marts 2016 om overførbare dyresygdomme og om ændring og ophævelse af visse retsakter på området for dyresundhed (dyresundhedsloven), særlig artikel 230, stk. 1, og artikel 232, stk. 1, og
ud fra følgende betragtninger:
(1) I henhold til forordning (EU) 2016/429 skal sendinger af dyr, avlsmateriale og animalske produkter komme fra et tredjeland eller territorium eller en zone eller et kompartment deri, der er listeopført i overensstemmelse med artikel 230, stk. 1, i nævnte forordning, for at kunne indføres til Unionen.
(2) Ved Kommissionens delegerede forordning (EU) 2020/692 fastsættes de dyresundhedsmæssige krav, som sendinger af visse arter og kategorier af dyr, avlsmateriale og animalske produkter fra tredjelande eller territorier eller fra zoner eller — for så vidt angår akvakulturdyr — kompartmenter deri skal opfylde for at kunne indføres til Unionen.
(3) Ved Kommissionens gennemførelsesforordning (EU) 2021/404 er der fastlagt lister over tredjelande eller territorier eller zoner deri, hvorfra det er tilladt at indføre de arter og kategorier af dyr, avlsmateriale og animalske produkter, der er omfattet af delegeret forordning (EU) 2020/692, til Unionen. Listerne og visse generelle regler vedrørende disse er indeholdt i bilag I-XXII til nævnte gennemførelsesforordning.
(4) Bilag V og XIV til gennemførelsesforordning (EU) 2021/404 indeholder navnlig listerne over tredjelande eller territorier eller zoner deri, hvorfra det er tilladt at indføre sendinger af henholdsvis fjerkræ og avlsmateriale af fjerkræ og fersk kød af fjerkræ og fjervildt til Unionen.
(5) Canada har underrettet Kommissionen om tre udbrud af højpatogen aviær influenza (HPAI) hos fjerkræ i provinserne Alberta (2) og British Colombia (1), som blev bekræftet den 12. november 2024 og den 14. november 2024 ved laboratorieanalyse (RT-PCR).
(6) USA har underrettet Kommissionen om 18 udbrud af HPAI hos fjerkræ i staterne Arizona (1), California (14), Illinois (1) og Utah (2), som blev bekræftet mellem den 13. november 2024 og den 21. november 2024 ved laboratorieanalyse (RT-PCR).
(7) Efter disse nylige udbrud af HPAI oprettede veterinærmyndighederne i Canada og USA restriktionszoner på mindst 10 km omkring de angrebne virksomheder og gennemførte sanering med henblik at bekæmpe forekomsten af HPAI og begrænse spredningen af sygdommen.
(8) Canada og USA har indsendt oplysninger til Kommissionen om den epidemiologiske situation i landene og de foranstaltninger, der er truffet for at forhindre yderligere spredning af HPAI efter disse nylige udbrud.
(9) Disse oplysninger er blevet evalueret af Kommissionen. Kommissionen finder, at i betragtning af dyresundhedssituationen i de områder, der er omfattet af restriktioner, og som er oprettet af Canadas og USA's veterinærmyndigheder, bør indførsel til Unionen af sendinger af fjerkræ og avlsmateriale af fjerkræ og af fersk kød af fjerkræ og fjervildt fra disse områder, der er berørt af de nylige udbrud, suspenderes for at beskytte Unionens dyresundhedsstatus.
(10) Bilag V og XIV til gennemførelsesforordning (EU) 2021/404 bør derfor ændres for at tage hensyn til den nuværende epidemiologiske situation med hensyn til HPAI i Canada og USA.
(11) Under hensyntagen til den nuværende epidemiologiske situation i Canada og USA med hensyn til HPAI, bør ændringerne af bilag V og XIV til gennemførelsesforordning (EU) 2021/404, der foretages ved nærværende forordning, træde i kraft hurtigst muligt.
(12) Foranstaltningerne i denne forordning er i overensstemmelse med udtalelse fra Den Stående Komité for Planter, Dyr, Fødevarer og Foder —
